IEEE承認限制華為人參與論文審稿:美國政府法規限制

IEEE將針對近期美國出口管制條例(以下簡稱“EAR”)的增加名單做出回應,同時進一步闡釋EAR對全球範圍內(包括中國地區)IEEE會員的影響。

2019年5月16日星期四,負責管理和執行 EAR的美國商務部工業和安全局(簡稱“BIS”)將華為技術有限公司及其68個附屬公司(在以下段落中統稱為“華為”)加入限制名單。見EAR第744部分的第4號補充內容。違反EAR的行為將受到重大的民事或刑事處罰,包括罰款或監禁。

Compliance with U.S. TradeRestrictions Should have Minimal Impact on IEEE Members Around the World

Statement fromIEEE

IEEE would like toclarify our response to recent additions to theU.S. Export Administration Regulations and what they mean to IEEE membersworldwide, including those in China.

On Thursday, May 16, 2019, the U.S. Department of Commerce’s Bureau ofIndustry and Security (“BIS”), which administers and enforces the U.S. ExportAdministration Regulations (“EAR”) specifically added Huawei Technology Ltd.and 68 of its affiliates (referred to collectively as “Huawei” in thefollowing paragraphs) to the BIS “Entity List” foundin Supplement No. 4 to EAR Part 744. Violations of the EAR carrysignificant civil or criminal penalties, including fines or prison sentences.

IEEE offers a wide range of activities and benefits for itsmembers, volunteers and thewider technical community, includingsponsoring more than 1,900 annual conferencesand events worldwide and providing access to over 4.8 million publications onIEEEXplore. Theseservices remain open to all, no matter theiremployer.

In providing these services (as a non-political, not-for-profit organization registered in NewYork) IEEE must complywith its legal obligations under the laws of the United States and otherjurisdictions. Compliance with these regulations protects IEEE, our volunteers, and our members.

IEEE complies with U.S.government regulations which restrict the ability of the listed Huaweicompanies and their employees to participate in certain activities that are notgenerally open to the public. This includes certain aspects of the publication peerreview and editorial process.

However, all IEEE members, including those employed by Huawei, can continue to participate in individual membership,corporate membership and voting rights; subscribe to and access IEEE’s digital library and other publicationproducts; submit technical papers for publication; participate in and present atIEEE-sponsored meetings and conferences, andmay sponsor and accept an IEEE award. Membersaffiliated with Huawei may also participate inbusiness, logistics, and other meetings including those related to conference planning.

Huawei and itsemployees can continue to be a member of the IEEE StandardsAssociation, including earning or exercising the voting rights of membership; attend IEEE standards development meetings, submit new proposals forstandards, and participate and comment inpublic discussions of standards technology proposals.

Should the U.S. governmentclarify the application of the EAR with respect to peer review we will furtheradvise the IEEE community.
